Babaçu livre e queijo serrano: histórias de resistência à legalização da violação a conhecimentos tradicionais
(2014-06) PORRO, Noemi Sakiara Miyasaka; MENASCHE, Renata; SHIRAISHI NETO, Joaquim
This article is about experiences carried out by communities whose ways of life generate and sustain traditional knowledge, in contexts of incorporation of international conventions into the Brazilian juridical system. Case studies on babaçu breaker women, in the State of Maranhão, and Serrano Cheese producers, in the State of Rio Grande do Sul, reveal the meanings of the tradition imbued in the knowledge to be protected. Empirical data analyzed under juridical and anthropological perspectives elicit, in spite of the apparent progress in the legislation, threats to multiple dimensions of ways of life grounded on traditional territories. Without effective, immediate and integral application of the ILO Convention 169, current initiatives of implementation of conventions and laws related to traditional knowledge may have opposite results. We conclude that traditional communities resist illegal appropriation of their knowledge, while interested private sectors search for the support of the rule of law to legitimize plundering.

This article is about the experience of a group of women in the commercialization of gathered wild fruits through the governmental Food Purchase Program (PAA) in the Brazilian State of Sergipe. The analytical framework is associated to the debate on poverty and specific public policies for traditional communities in rural areas. The women hold a collective identity as the mangaba gatherers, based on their use of common pool resources with low environmental impact. They mobilize themselves through the MCM – Movimento das Catadoras de Mangaba, Mangaba Gatherer Women´s Movement. Although they have recently been recognized as having specific legal rights, they are experiencing the dwindling of the resources they gather, as well as difficulties in commercialization of the fruits due to their seasonality and the unpredictability of access. The research was carried out between 2008 and 2011 and involved direct and participant observations and open-ended interviews. The main results show that the PAA has contributed to increased income, consumption and self-esteem. There was a re-arrangement in their way of participating in the program, meanwhile some of their traditional practices were relegated. The program rules were re-signified and adapted locally. While growing solidarity has been observed among the gatherers, competition for the fruits has also increased.

The objective of this paper is to analyze the local interpretations of public policy programs by mangaba gatherer women. The Food Acquisition Program (PAA) and the Insurance Program for Artisan Fishermen were assessed, regarding women with regular or occasional participation. Field observations and open and semi-structured interviews were carried out and analyzed in the light of the theoretical contributions of sociology. The findings indicate that both programs provide improved income and higher self-regard to the affiliates. They differ, however, regarding the use of natural resources: temporarily interrupted in the case of fishing and stimulated in the mangaba gathering. In relation to the local interpretations, the relationships promoted by the PAA are more market-like due to the contractual requirements. The Insurance for Fishermen is perceived locally as a welfare program, a sort of support from the government to the poor population, demanding however a return, which depends on the individual conscience.

The article discusses the role of turnover of peasant families at agrarian reform settlements for the local development of the Transamazon region in the State of Pará. Analysis of local practices and narratives in the context of land and environmental policies evidences that their current implementation is not consistent with processes of territorialization designed by so-called beneficiaries of land reform.
