The objectives are to analyze the contributions of Michael Foucault's Genealogy to the understanding of sexual abuse of children and adolescents when committed by the subject teacher; To discuss the forms of knowledge and power adopted by scientific production in order to objectify the practices of sexual abuse against children and adolescents committed by the teacher; Reflect on the coping policies (powers) that come into play to this event within the established programs and governmental actions and how they are applied on the bodies of children and adolescents; Identify and discuss the manner in which the Judiciary has been producing its jurisprudence in cases brought to its appreciation and the relations of power and process of subjectivation that these documents produce. How are research problems highlighted What is the importance of Michael Foucault's Genealogy in the problematization of the analyzer sexual abuse event against children and adolescents practiced by the teacher? How are the practices of knowledge and power triggered for the objective scientific production of this type of sexual abuse? How do such practices come into play and how are they triggered on the bodies of sexually abused children and adolescents by the teacher? How has the judiciary been producing its Jurisprudence in cases brought to its appreciation in relation to the delinquent professor? The methodological theoretical framework adopted is based on a historical-genealogical analysis proposed by Michael Foucault. Bibliographical and documentary research covering the period from 1998 to 2016. The theoretical and documental evidences showed that the sexual abuse event has become the object of study in different researches carried out in the various areas of knowledge, transforming itself into an epistemological investment field, Particularly in the dissertations and theses produced and defended in the Graduate Programs in Brazil. However, there are few works that approach this phenomenon having as principal agent the subject teacher. Moreover, in the area of education, this subject is still covered by taboo, but within the jurisprudence of the Court of Justice of the State of Pará, the decisions show that, despite the entire system of guarantees and public policies in Brazil , The teacher who is invested with knowledge and pastoral power, instead of being a subject that promotes citizenship and human dignity through the school education process, becomes a delinquent who makes his profession a means of enticing children and adolescents to perpetrate sexual abuse.Item Acesso aberto (Open Access) Hermenêutica gestáltica do abuso sexual para uma adolescente(Universidade Federal do Pará, 2007-06-29) ARAÚJO, Lucivaldo da Silva; PIMENTEL, Adelma do Socorro Gonçalves; http://lattes.cnpq.br/4534230240595626This qualitative research of orientation Phenomenology, existential gestalt, tries to reveal some meanings attributed to the phenomenon of the abuse sexual inside family, through a case study in that the informer, of the 9 to the 11 years, were been victim for the father and still today, in her existential field, she is influenced by the existence of that experience. The violence against the child, in their several modalities, is a problem of public health and of relationships between family and who takes care the child. In if treating of the sexual abuse, in that the aggressor is the responsible for the primary cares, usually, there is denial for the victim, aggressor and the family, and almost always, it happens, involving more than a violence modality. Same not having a consensus among the authors, it is puts in prominence the noxious effects of those events on the health psychic, occupational, physics and the victims' of the development. The data were collected in ONG Republica of Emaús including reading of documents, informal reports, participant observation and interview with the adolescent, being this last one, the main appreciation source. The analysis of the interview conjugated, insofar as possible, the theory of the interpretation of Ricoeur, some concepts of the gestalt-therapy as the one of contact, illustration-bottom, and psychological nutrition and of the Occupational Therapy, as areas, components and the performance contexts. Of the interview were created units of significance that orientated the reflections concerning the meanings of the adolescent's speech. Some results are: presentation of the weight of the existence of the sexual abuse some times as evidence sometimes as bottom; repercussions owncontact without functionality and contact with the other; in the own-image, selfesteem and in some acting areas: learning and socialization. The creative adjustment can be identified in the opening in revealing the experience, what suggests expansion of their contact borders. The dissertation was divided into two empirical papers, one quantitative and the another qualitative. The first article discusses the characterization of patterns of disclosure/discovery by analyzing records of sexual abuse from two brazilian states, investigating the association between these patterns and individual and relational factors. The second article presents the characterization of maternal support, based on data from semistructured interviews implemented with five mothers of children and adolescents victims of sexual abuse in a city of Pará-Brazil.Item Acesso aberto (Open Access) Restou (in)frutífero: reflexões psicanalíticas sobre o não-todo dizer de crianças no Depoimento Especial do Judiciário Amapaense(Universidade Federal do Pará, 2024-09-30) GUEDES, Elizabeth do Socorro Moraes; NICOLAU, Roseane Freitas; http://lattes.cnpq.br/0430583046421802; https://orcid.org/0000-0002-6988-943XFrom the dialogue between Psychoanalysis and Law, prompted by psychoanalytic praxis within the Judiciary System of Amapá, this research emerged in the context of the Santana County Court. It was here that the first clinical-political inquiries regarding the Special Testimony arose-a type of institutional interview conducted in a room equipped with an extensive audio and video system, where the Judge can observe and ask questions through a trained professional capable of interpreting and adapting them to the language of children and adolescents involved in judicial proceedings, either as witnesses or victims of abuse and/or sexual crimes. The procedure aims to crown a set of legislative, legal, and political practices focused on maximizing the reliability of testimonies presented in court and protecting victims and witnesses of crimes in Brazil. Due to some children’s behavior or testimonies not meeting the institution's expectations of attaining factual truth, such cases were redirected to psychological listening under the label “proved fruitless”, which, having become a significant term, assumed the central theme of this dissertation. The initial hypothesis was that, when confronted with unconscious manifestations, the social actors within the legal scene conclude that reaching the truth is impossible, and thus the child's testimony cannot be validated as evidence, leaving the case marginalized, in a residual space within the institution. From this standpoint, the aim of this research was to analyze the impossibility of fully verbalizing the experience by children in the Special Testimony, based on the concept of the subject, articulated with the psychoanalytic concept of objet a. The “Remainder,” as formulated by Lacan, when linked to the theme of this dissertation, led to various paths, revealing what is strange, obscure, repulsive, and unsettling in human experience, which emerges daily in courtrooms across the country. Regarding methodology, the psychoanalytic method, specific to research in Psychoanalysis, was adopted, supported by the works of Sigmund Freud and Jacques Lacan, as well as contributions from contemporary authors in the fields of Law and Psychoanalysis. “Case fragments” will be presented, based on the psychoanalytic listening of children, to explore singularity and, in doing so, facilitate the articulation between psychoanalytic theory and practice. As a result, it was concluded that psychoanalytic listening has its place within the Judiciary, as what may remain "fruitless" during the Special Testimony or any other listening context in the Judiciary can, in fact, become fruitful for psychoanalytic praxis.
