    A mediação de conflitos no Tribunal de Justiça do Estado do Pará: uma possibilidade de transformar conflitos familiares

    This dissertation carried out to ponder on the possible mediation as a tool in family’s “judicialized” conflict transformation, from the experience of the Center for Conflict Mediation Court of the State of Pará. As a result, it presents a study of mediation, conciliation differentiating it from making a brief history of its regulation in Brazil, as well as intervention in its path, where they demonstrated their basic principles and techniques. It is a synthesis of the trajectory of their deployment in that Court, as well as the difficulties encountered in this journey, and still presents the results of the practice of mediation in the Nucleus in question, from January 2011 to December 2012, almost two years from the date of its implementation. The following discussion is a reflection on the possibility of mediation in the judicial context, considering the tensions that underlie the relationship between institutions and individuals, using as reference Paul Ricoeur. Finally, it follows that it is possible to indicate the transformation of family disputes through mediation judicialized, basing this conclusion on whether philosophical perspective of Martin Buber, and dialogical encounter the narratives of the subjects participants heard of this practice during the research developed to perform this work.

    Percepção de conflito em uma família recasada constituída por um filho com paralisia cerebral

    The increase in the number of separation/divorce has favored the emergence of new family structures. Thus, remarriage becomes a possibility for developing the family group which requires emotional, social and economic reorganization of the family, as well as greater flexibility to negotiate association, space, time and authority. The objective of this article was to describe the structure and dynamics of a stepfamily having a child with cerebral palsy, based on the members' representations of conflict situations. In this case study focused on a family, made up of three members: mother, son and stepfather. A semi-structured interview and the Family System Test (FAST) were applied. The FAST scores showed closeness in the mother-child dyad and distance in the stepfather-stepson dyad, with the hierarchy focused on the mother figure. As to the flexibility of boundaries, the couple's perception indicated rigid boundaries, both for the family and for parental systems, while the child's perception of the family system revealed diffused boundaries. Therefore, some factors highlighted in the literature and evident in this family such as differences in the couple's life cycle, short period of marriage, emotional baggage between mother and son, added to demands of child care, resources and biopsychological provisions, constituted a rigid standard with low flexibility, which made it difficult to include the stepfather in the group, resulting in less commitment to co-parenting in the care and education of the stepchild.

    A relação conjugal em debate: uma análise gestáltica

    The marital relationship is the subject of this research, highlighting the problem of identifying the couple's perceptions about what keeps the marriage. In general, to understand the reasons that kept the couple together. When searching for the marriage, the studies of gender subjectification is needed to understand the complexity of the influences, changes in society, echoed in the social roles and relationships between men and women. These changes reverberated socially, economically and culturally, leading to a crisis in masculinity, among other fields, the principles that guide the family and therefore the marriage in the care and choice to bear children. The theoretical and methodological procedures consisted of: a) project submission to the Ethics Committee of the Center for Health Sciences, b) selection of subjects by the researcher's network of relationships, c) telephone or in person with the primary informants for verbal agreement to join the study d) personal encounter with the subjects to explain the research objectives and deliver the term of consent, explanatory document which summarizes the goals of research, e) that the interviews were audio taped and transcribed. As the analysis it was considered the guidelines of Minayo (1992). The informants were three couples with 4-6 years of marriage, with children, aged between 30 and 40. Gestalt analysis was performed. The result points to the conclusion that marriage in postmodern society ceases to be a binding obligation by way of passing the permeate a healthy choice and favoring the emergence of autonomous elements such as love, trust, dialogue, listening and hence an interaction within intimate relationships healthier.
