Item Acesso aberto (Open Access) A consensualidade administrativa e o direito à moradia na Amazônia: uma análise do diálogo no promaben I(Universidade Federal do Pará, 2023-04-28) MONTEIRO, Gustavo Tavares; OLIVEIRA , Assis da Costa; http://lattes.cnpq.br/1543002680290808; https://orcid.org/0000-0003-3207-7400This the final report of the research that pursued to answer how does the institutionalization of dialogic participation in legal acts related to living rights, in the stages of formulation and execution of public policies, related to the right to housing, impact the guarantee of this fundamental right in the cities of the Amazon? To answer to the question, the case study methodology was adopted to analyze the first stage of PROMABEN. A bibliographic review of legal texts and texts from other sciences was carried out, as well as the collection of empirical data, such as documents and interviews. Data analysis was carried out through the idea of a cycle of public policies and through the dialectical method, comparing institutionalization with practice. The research identified, in the case, a deficient institutionalization of the dialogue. A causality between the deficient institutionalization of dialogue and its ineffectiveness was verified. The necessity to improve dialogue in public policies like the researched phenomenon was found, by breaking with the ideological bases of Brazilian administrative law, originating from the Liberal State. In addition, it is necessary to strengthen the Democratic State of Law, established by the Federal Constitution of 1988, which requires that the public administration adopt a consensual conformation. The dissertation analyzes the Citizen Housing Project in Concórdia do Pará and favors the approach which comprises decent housing as multidimensional, revealing the critical point that the benefits generated by the agrarian regularization project are limited.Item Acesso aberto (Open Access) A Posse segura da terra urbana como instrumento de emancipação das mulheres: análise das ações desenvolvidas pelos Programas Chão Legal e Terra da Gente no Município de Belém do Pará(Universidade Federal do Pará, 2023-02-27) BARROS, Thayanna Paula Neves; TRINDADE JÚNIOR, Saint-Clair Cordeiro da; http://lattes.cnpq.br/1762041788112837The purpose of this dissertation is to analyze the set of actions aimed at women within the municipal land title regularization programs executed by the Belém Development and Administration Company (CODEM), the Chão Legal Program, in effect between the years 2010 and 2020, and the Terra da Gente Program, its replacement since 2021. Therefore, we investigate the historical context in Brazil, in the Amazon and in the municipality of Belém, which structured the access to land property under exclusionary criteria, based on social markers of gender, race and class, which also acted on the construction of the related legislation and, for a long time, were obstacles to women's access to land and its secure tenure, a right that only more recently, from the 2000s on, was fostered by laws and public policies on housing and land tenure regularization. To understand this scenario, the interpretation method adopted was the historical-dialectical materialism according to the gender perspective proposed by the Marxist feminist theoretical current. As for the research techniques employed, qualitative and quantitative data were combined, obtained through the articulation of bibliographic, documental, and statistical research and interviews conducted with CODEM's former technician/advisor and employees, as well as with the women beneficiaries of the Chão Legal and Terra da Gente programs, in order to identify actions to promote priority assistance, host and of aid the women beneficiaries, and guaranteeing not only the security of land tenure through the title deed, but also to ensure the right to decent and adequate housing, with access to urban infrastructure and public services, as an extension of the right to the city.
