    Contributos hermenêutico-filosóficos para uma fundamentação ética dos direitos humanos: a epocalidade e o cotidiano sob o pensamento de Heidegger e Gadamer

    The present work develops some essential issues of philosophical hermeneutics as a way to fundament human rights in its ethical determination. The discussion is conducted as a hypothesis to face two problems: the representational model of the contemporary scientia juris and its methodologized way of interpretation may not fundament human rights in its proper reason of being. Still, as a consequence, these two problems might be seen as one of the causes to a “rational” but innocuous criticism about human rights as well. Therefore, the philosophical sense of the quotidian – of the “common” – is here discussed as a proper way to analyze the practical routine of law´s everyday interpreters as a pragmatic way to justify the need for human rights in a contemporary law practice. To discuss it, the thematic of intuition is here worked in its existential basis: so, in that way, human rights can be apologized as a substantive part of our intuitions about what is the most fair. Moreover, these fundamental rights can be even thought as a practical way to find out, normatively, the best right – the best law for our epoch. Heidegger leads us to investigate human rights as a necessary event for our time by its ethical significance. In other words: these rights constitute part of the movement of our being-with in its symbolic and suggestive significances. Gadamer help us to interpret that radical philosophical way by hermeneutic terms: to the law reality that idea can be seen as a re-turn to some lost concepts of our humanistic culture. With Gadamer we still can affirm that law is a practical “philosophy” in its most fundamental determinations. Therefore, the Greek disposition for the phronésis is, nowadays, a proper way to see human rights as an ethical manifestation for the best, for the most fundamental goods. Still through the philosophical hermeneutic ideas, we conclude the work with a more specific discussion about the relations between our intuitions, convictions and our pre-conceptual structure which determines the worldness of our concepts into Law´s social practice.

    The question of language in the years 1932 to 1934 emerges as an urgent matter of foundation and, let alone, redirection of Heidegger's thought. The philosopher feels the need to base his phenomenology with a new methodological bias that allows a visualization of the context and assurance of the bases in which the being-there is, in a context of being already with one another. This context of already beingone-with-another will at no time is of secondary importance in relation to language, but it will have to be deployed in its details for the assumption of language itself as the driving force of Heidegger's thought in those years. For this, Heidegger, In the summer lecture of 1934 entitled "Logic as the Questioning of the Essence of Language”, begins by making an analysis of what is the essence of language and comes to the conclusion that we will not reach this essence if we understand language only as an exposition of the modus operandi of thought : Logic. The essence of language springs from the essence of the being of the human being as a historical being. Language arises as a measure of the innermost limits of the constitution of being-there while being-one-with-another, or to be even more in keeping with Heidegger's pretensions, the innermost limits of being-there history constituted as Volk. In this context, language is more than a mere instrument at the disposal of man. On the contrary, language is that which first disposes the being of man in the world, opening the possibility of being in the midst of beings, giving him an understanding of the relationships in which he is inserted. We must understand language not as a logical-grammatical device of articulation of words, but rather in the phenomenological sense as a primary organizer that makes sense of the relationships between beings and beings-there.

    Fenomenologia da Comunicação em sua quotidianidade

    The article reflects on the relationship between Communication and communicative everyday processes using Martin Heidegger's philosophy. Intending to interpret the communicative phenomenon from a phenomenological and hermeneutical approach, we seek to understand Communication as tacit condition of every being in the world and we discuss the banal and quotidian character of Communication through Heidegger's notion of idle talk (Gerede), comprehended it as a fundamental communicative experience. The aim of the paper is to understand the Communication in its most basic phenomenal condition, wich we have identified as their intersubjective condition. With this proposition, the article also seeks to understand Communication without the metaphysical bonds that are required to think on it, in other words a condition of effectiveness of language and meaning. Doing this, we start a phenomenology approach by which Communication could be comprehended as intersubjective and daily phenomenon.

    Guimarães Rosa e Martin Heidegger: duas visões sobre o Nazismo

    In 1970 occurred the publication of the posthumous book Ave, palavra of Guimarães Rosa (1908-1967) which gathers some texts of the author, from this collection of texts it has chosen the chronicles “O mau humor de Wotan”, “A velha” and “A senhora dos segredos”, which revolve around the context of German Nazism and expose a contrary position to National Socialism. At first moment, this work aims to show how Benedito Nunes (1929-2011) was guided by an interpretive tendency designed by heideggerianos commentators before the complete works [Gesamtausgabe] (2001), such a tendency postulates that there is not, in the philosophy of Martin Heidegger (1889-1976), a link between the political thought and the philosophical. The next step exposes the heideggerian notion in Ser e Verdade (2001) in which the german philosopher proposes an ideological basis for Nazism, being in favor of this with certain restrictions. This way, it shows how the complete works set out arguments that point to a limitation in relation to the commentators who produced before its publication about Politics and Philosophy in Heidegger. In subchapter about O local da diferença (2005), it deals with trauma and testimony as central concepts that the author puts to theorize the Literatures of the 20th century in the contexts of war and authoritarian regimes. After, it makes a critical reading based on the premise of philosophical political thought on Heidegger in the chronicles of Rosa, because they expose images from the period of Nazi Germany when the brazilian writer was working as a diplomat. The second review of the war chronicles will be made based on the concepts of trauma and testimony formulated by Seligmann-Silva (1964), because the works of Rosa treated demonstrate the level of authoritarianism of the Nazi party. Finally, it will be made a definition of the concept of reception of Hans Robert Jauss (1921-1997) to then discuss the authors who made the critical reception of the chronicles of Guimarães Rosa.

    Heidegger e a metafísica do Dasein: o acontecimento irruptivo da transcendência em meio ao ente na totalidade

    The present study aims to delineate the moments in which the problem of transcendence gets a more precise characterization inside the thought of Martin Heidegger. The idea of surpassing of beings towards Being that continually follows the Dasein in its relations with the beings, that is, transcendence, does not serve to qualify what surpasses the man (God, for example), but really a surpassing of the man himself. When Heidegger, exposing his interpretation of Aristotle's concept of time, says that "time is what is beside-of, it is similarly gives an interpretation and meaning corresponding to the meaning of Being, that is, a transcendental characterization, where it is understood as a "besides". The analytical accompaniment of the concept of transcendence will be exposed in two central moments. First, it will be exposed how this problem appears by the light of the themes of temporality. Heidegger outlines a connection between temporality and transcendence, in that the being-in-the-world is the phenomenon in which originally it is announced how the Dasein is, in essence, besides themselves. Moreover, if we aim to show the rise of the metaphysics of Dasein inside Heidegger's philosophical project, it becomes necessary to understand that the protagonism of the problem of transcendence shows up as one of the keys of this project. In the end, it will be showed up how this "phenomenology of transcendence", finally, it is constituted through the ways of the problems of the foundation and the freedom, trying to show how the metaphysics is a fundamental event in the Dasein.

    Phenomenological qualitative research approach, which used as a theoretical and methodological framework philosophy of Martin Heidegger expressed in his work Being and Time. Study conducted at the School of Nursing, Federal University of Pará in the second half of 2013 and aimed to: reveal the meanings and feelings that the nursing professors of the second and third semesters of the undergraduate nursing of Federal University of Pará express on mental health in daily life to be teaching. Participated in this study of nine nursing professors curricular activities Introduction to Nursing ( 3 ) Integral Attention to Women, Children and Adolescents ( 2 ), Health Care for the older persons ( 2 ), Educational Process I ( 1 ). Professional Practice and Health ( 1 ). The expressed by teachers was captured by phenomenological interview scheduled with each teacher and analyzed by ontic instance as regards the vague understanding and median. Five units of meanings emerged: US1 - mental health is natural phenomenon that manifests itself in the freedom to be and how to be with each other in a balanced relationship. US2 - the significance of mental health as the essence of the experiences expressed in the possibility of access to the things of the world. US3 - mental health is revealed in everyday nursing practice in different stages of life in a given occupation simply. US4 - Mental Health manifested in the training process as a secondary event. US5 - how to be a teacher in their life experience influences relations with each other in the training process. The revealed in the study, through what was spoken, perceived and experienced, expressed concern that mental health is an event, however this does not constitute as possibilities, ie, there is an early occupation of mental health as content formal study of this or that activity. It is possible that teachers in their way of being able to open up again, launch into the world and promote changes in the daily training of nurses, taking care of mental health, because even without this in the syllabus content there the recognition of its existence and its importance in the temporality of life of the people.

    The text presented effective discussion of the main concepts being-toward-death and self-esteem of the philosopher Heidegger's philosophy, based on the book Being and Time, with the aim to understand how the being-toward-death implies ownership of selfesteem. The methodological basis used is that of phenomenology, hermeneutics, created by the author himself to realize their concepts, forming the body of his work. Writing is developed in three chapters. The first is an overview of Heidegger's thought, retracing the route of his philosophizing, explaining the use of concepts through comprehensive explanations, ranging from the self, passing by Dasein, to the being-fordeath ; is also a foundation for the next steps. The second chapter is more strongly beunto- death in the link with the literature, the book "The Death of Ivan Ilyich" by Leo Tolstoy, demonstrating the experience of the character of the settlement itself, to face his dying prematurely after being challenged by anxiety, comprising be-unto-death. In the third chapter a summary of the issues discussed with emphasis on self-esteem, conceiving the Heideggerian concepts such as care, impersonality, chatter, used in understanding education in Heidegger will be taken.

    Silêncio e abertura na arte contemporânea: reflexões a partir de Heidegger

    Starting from the place that silence occupies in the thought of Martin Heidegger as an element capable of provoking different perceptions of the world, this research intends to create a discussion about the use of silence as a factor of openness in contemporary art. We believe that, in the peculiarity of its existence in a social scenario dominated by technique, silence can cause a genuine experience in the public. In order to achieve its goals, this work will situate silence as an authentic form of language manifestation in Heidegger, and will also bring John Cage's understanding of it to the analysis, given its paradigmatic character and relevance in the context of the contemporary arts. Finally, we will be analyzing artworks that corroborate the exposed proposal, in an approximation with the notions of openness and art experience.

    Transcendência, liberdade e mundo: como Heidegger estrutura o Ser-aí a partir destes conceitos no final dos anos 20

    The objective of this dissertation is to point as Martin Heidegger presents, and his late texts of the 20s, the concepts of transcendence, freedom and world, and how, from these concepts, it structures the being-there. The theme of this work is based more precisely in the texts Introduction to Philosophy, Essence of Human Freedom and Metaphysics of Logical Reasoning, making some inroads in the text Metaphysics of Fundamental Concepts: finitude and solitude world and sometimes alluding to Being and Time. These five works of Heidegger we find a structure of Being-there where Freedom and Transcendence appear as the essence and the very foundation of this one, the Self-ai, as a being in the world forming world. Our project was divided into three stages, in Chapter 1 shows how the concept of transcendence permeates the late 20, in chapter 2 the concept and thematizations Heidegger on freedom are linked to the concept of transcendence, and finally, in chapter 3, Heidegger's understanding of the world is presented completing the structuring being-there's like being in the world, from the entanglement and belonging of world and transcendence on the transcendence of self and the world, and in turn belonging of world and freedom, in that transcendence and freedom are presented by Heidegger as the foundation for the possibility of existence of Being-there as being there in the world as being in the world, the clearing of being, as guardian and formed mundo.omo the one being in the world forming world.
