O ensino religioso na rede estadual de educação do Amazonas: primeiras observações em um campo novo

This article is configured as a preliminary work on the provision of Religious Education in the State of Amazonas and focused on the legal aspects of the discipline at national and state level. For its production, I consulted the normative documents related to this discipline at the state level, comparing them to national legislation and other related documents in order to find convergences and divergences between them. In this process of approximation, it can be seen that Religious Education in Amazonas went back in the form of admission of teachers in relation to the discussions held at the national level and that it was even more inconsistent with the recent opinion of the National Council of Education establishing the Degree in Science (s) of Religion (s) as the formation of the teacher of Religious Education in Brazil.

A guarda nacional da província paraense

This article tried to contemplate on some subjects that helped to reveal tensions in the Província Paraense. Discussions, as the national guard’s appearance, his/her legislation and his/her formation, are thematic that compose this work and the object in subject, exactly for provoking debates and inquietudes in the breast of the Província Paraense of the first half of the century XIX. This way, the problematização controls in understanding as certain social subjects - national guards - they were made presents in the breast of the society wrapped up paraense in tensions and relationships of force in a period of intense infra-structural transformations that the own Regency tried operacionalizar. The guard’s national paraense formation, in this context, was constituted as normatização mechanism and adaptation of a pattern comportamental legalistic tax to a society - until then “forgotten” - that had different interests, that space from the simple treatment of the farming to needs tied mercadológicas the Portuguese metropolis.

Legislação ambiental e economia do crime na BR-163 e PA-370: análise do mercado madeireiro ilegal

The state of Pará is home to a significant portion of regional vegetation, and this opens the economic eye toward profitability - licit and illicit, that the forest can generate through logging. The Environmental Crimes Law was created to combat and punish environmental illicit such as illegal logging. In this sense, the general objective is to carry out the environmental economic analysis about the seizure of illegal wood from processes processed / judged and finalized under the jurisdiction of the archive of the Santarém Forum (PA), registered in the years 2006-2016. The data come from cataloging performed in the archive of the Forum of Santarém, tabulating: the year of infraction; the type of person who committed the crime; the type of charge seized - identifying the volume and the species (s); as well as the fine imposed by environmental agents and the final fine paid. From this, through statistical programs, the methodological technique of cost-benefit estimation of the illegal timber market was applied, which compared the estimated value of the load - environmental economic loss, with the fine that was paid by the offender after the final decision given by the judge. The analysis of the results was based on the specificity of Law 9.605 / 98 regarding illegal logging and, in Gary Becker's economic theory, focused on the analysis of criminal activities. In sum, it was observed in the results that the estimated value of the charge seized, in almost all cases was greater than the fine imposed, the latter can still be paid in installments, making the environmental recomposition is minimal. It is evident that if the initial penalty were applied, the offender's average profit margin would be approximately 31.74% in relation to the potential benefit, which, according to Becker's theory, would keep the illegal activity in full employment. operation. However, the results show that, on average, that profit margin of the potential crime benefit amount is approximately 67%, which makes logging illegally attractive and rewarding, as the 'potential benefit' of the activity has been quite higher than the economic costs of the penalties. Therefore, it is necessary to apply more effectively the Law on environmental crimes, as well as governance activities in relation to hiring more environmental agents to prevent, combat and seize loads that are out of illegality, as well as greater activity judiciary in judging cases.

Ocupação de terrenos de marinha: risco e regulamentação jurídica.

The present research has as objective to treat the marine lands and their increased, that as assets of the union, were also instituted as source of income of the same. Currently, they are enshrined in the federal constitution of 1988, as well as by decree-law no. 9,760 / 1946, by decree no. 3,725 / 2001, as well as by law no. 9,636 / 1988. The navy lands and their awnings may be established as sunday goods, goods of common use of the people and goods of special use. It is extremely important to also consider pec no. 39/2011, which aims at securing the land of the navy, as well as the question of the demarcation of these lands that is presented from the preamar average line of 1831, and the secretariat of the patrimony of the union - spu civil liability and the principles of environmental law, as well as the multidisciplinarity of disciplines of civil law, environmental law and disaster law, are necessary in order to the compression of the dimension of the subject and the problem presented. It is also understood that it is necessary to maintain the institute of marine lands as a good of the union, looking not only for the collection interest, but mainly for preservation, as well as for environmental recovery, transforming this institute into real service of the socio-environmental function and, moreover, as being mainly recognized with a constitutional aspect. Based on the results obtained, and based on the analysis carried out on the study of the demarcation of brazilian navy lands, based on the national characterization plan developed by the spu, it was verified that much remains to be done in relation to the demarcations and, the importance of the navy land remaining as assets of the union, overcoming the lack of instruments and advancing to the recognition of the constitutional expression of this institute and in this way, the research went to the creation of a "normative act" in the species "recommendation", to the technicians of the municipal government of abaetetuba, who are involved with the public service situations inherent to the marine lands.
