Thus, the theoretical framework used to undertake the analysis includes some authors / the educational area, as well as attempts to link them to the discussion with some concepts developed by Foucault on liberalism, governmentality, power knowledge, subjectivity and education. Education, in this perspective becomes one governamentality apparatus that builds speeches and visibilities that subjectify subjects in different ways. In Brazil, the liberal education combined with the desire to modernize bodies and another company, engendering forms of government to operate on the social spheres, cultural, political, ethical and economically in the lives and bodies.Item Acesso aberto (Open Access) Lei e liberdade na ADPF 130: uma leitura da decisão a partir de Hannah Arendt(Universidade Federal do Pará, 2013-06-27) MASCARENHAS, Diego Fonseca; COSTA, Paulo Sérgio Weyl Albuquerque; http://lattes.cnpq.br/4135075517359609This thesis aims to analyze critically the judged case of ADPF 130 over the light of Hannah Arendt’s political thought, for this thesis leads the discussion of the meaning of reputable press in the promotion of freedom of expression, as it can make effective the principle of publicity in the public sphere. Arendt’s thought contributes to critically evaluate the rationality of the Brazilian Judiciary in the decision of ADPF 130 because Judiciary claims doubtfully that the press has a forming public opinion democratic role and that any law to regulate media activity implies an immediate falling into the risk of censorship. Chapter 1 summarizes the arguments proposed in the ADPF, in order to show that the votes of ministers are mostly based on general conceptions of liberalism and its consequences in the performance of the press in brazilian democracy. Then, the beginning of chapter 2 outlines the main characteristics of Arendt’s political thought in The Human Condition and in Origins of Totalitarianism. These descriptions were presented to place these works in the political tradition of western political thought, exposing the general contours of its political system, characterized by vita activa and doxa, by the function of the law and by the distinction between public and private domain. In its final part, chapter two analyzes the expressions of Arendt`s thought about the free speech and the meanings of ideal press in this situation. The aim is to test her political thought in practical elements, verifying its applicability in face of the concrete reality of the decision that revoked the press law. Chapter III puts Arendt's thought in the political tradition of the Western world. Arendt highlights when political freedom, manifested between the capacity and the will, dissociates, producing obstacles to the emergence of doxa in the acting in concert, among men. Thus, mistakenly, politics becomes, apparently, nothing more than an old truism to ensure freedom. In this context, it is understood that the press is conceived by the majority of the votes of the ministers, with the role of forming public opinion because, implicitly, they consider us living in a democracy where men do not participate effectively of public life.Item Acesso aberto (Open Access) O liberalismo de princípios aplicado à judicialização dos direitos sociais fundamentais: uma proposta para a superação de limites de atuação do poder judiciário(Universidade Federal do Pará, 2015-12-18) PAES, Carolina Bastos Lima; BRITO FILHO, José Cláudio Monteiro de; http://lattes.cnpq.br/7823839335142794The 1988 Constitution of the Federative Republic of Brazil has enshrined the dignity of the human person as one of its fundamentals, and has brought forth a vast amount of fundamental rights and guarantees to be applied and implemented by the State, with maximum priority, as instruments for the fostering of this fundamental principle. Among the constitutionally guaranteed rights to the individual, are the fundamental social rights, which aim to provide basic material conditions to all individuals in order for them to draw up and pursue, in a free and conscious way, their individual life plan. However, the practical implementation of those economical and social rights has not sufficiently met the demands set by the human dignity principle, neither through legislative and administrative means nor in judicial seat. This happens because, more often than not, the existence of the social rights, if not their enjoyment, remain conditioned to the availability of enough public resources to cover the costs of its implementation. Starting from this problem, the current dissertation aims to improve the actions of the Judiciary in the exercise of its goal of guaranteeing solidity to the constitutional norms that define the fundamental social rights. Towards this end, theoretical support is found in the liberalism of principles, more specifically, in the theory of justice as equity, by John Rawls, with complement offered by the equality of resources, by Ronald Dworkin, and by equality of capabilities, by Amartya Sen, instead of the utilitarianism that guides not only the elaboration and execution of social policies, but also the judicial intervention in these policies, in the manner in which it often comes forward. The goal is to allow the diversion of the attention of the judicial authorities, until now focused on the collective well-being, towards the individual, in a way in which the limits of action of the Judiciary can be overcome, for, then, at least in this extraordinary way, the State cabe made to answer, in adequate levels, the basic needs of all individuals, in trune accomplishment of its constitutional duties.Item Acesso aberto (Open Access) Monetização dos riscos no meio ambiente do trabalho uma leitura a partir do liberalismo igualitário(Universidade Federal do Pará, 2014) TAVARES, Sílvia Gabriele Corrêa; NASSAR, Rosita de Nazaré Sidrim; http://lattes.cnpq.br/2092928958819725This thesis analyses the Risks Monetization in the Work Environment – phenomenon that authorizes the financial compensation for the worker due to his exposure to risks existing in the place of work –, which is done by the optics of the Egalitarian Liberalism of John Rawls and Ronald Dworkin. The first chapter analyses and compares the liberal egalitarian theories presented by John Rawls and Ronald Dworkin with the Economic Analysis of the Law theory of Richard Posner. The second chapter demonstrates which are the brazilian juridical practices related to the risks monetization. The third chapter makes a norm and principles based analysis in order to answer if it is necessary to reform those practices, analyzing, yet, which are the obstacles for the effective workers protection.Item Acesso aberto (Open Access) A proteção da educação no direito internacional dos direitos humanos e a prestação privada deste direito: possibilidades de uma adequação dos vouchers educacionais aos standards de direitos humanos?(Universidade Federal do Pará, 2018-03-26) PEREIRA, Bianca Araujo de Oliveira; SILVA, Maria Stela Campos da; http://lattes.cnpq.br/6127087703635751The present work discusses the possibility of reconciling educational vouchers – a model of educational services provided by the economist Milton Friedman - with the standards for the right to education, based on the special reports on the right to education, made by former rapporteur Kinshore Sing. To analyze this possibility, it is first approached the origin of the United Nations and its relationship with the promotion of the access to education. Next, the strands of liberal thought are discussed, followed by the dialogue between the critics of philosophical liberalism; there is also the approach of Public Choice Theory, New Public Management and its critics. The work also uses the empirical approach, based on a review of the existing literature, in order to elucidate the positives and negatives effects on the use of educational vouchers, in order to be able to answer the proposed research question.
