The work exhibits one precedents theory, based on the theoreticals of legal reasoning Neil MacCormick and Robert Alexy, with the objective of defending its application in the Brazilian legal order from the analysis of devices of the Code of Civil Procedure and the Supremo Tribunal Federal decisions. In the legal field, it is sustained the interpretation of devices to the use of precedents under the perspective of the proposed theory, highlighting the concepts of coherence and integrity. In the practical field, despite the existence of a different conception from the Supremo Tribunal Federal’s ministers about the use of precedents, the change of this vision is defended.
