Das ruas para o sistema penal: "outsiders" e mídia no contexto das manifestações urbanas

The fragility of the Brazilian democratic state is perceived through constant difficulties for a guarantee of fundamental rights, and this scenario has just mobilized a population to seek ways, albeit informal, to express their demands. In 2013 and 2015, in the city of São Paulo, events occurred that exemplify the phenomena of urban manifestations, not our last years, and which became a public security agenda in the mass media. Based on these findings, this paper proposes a solution carried out by means of mass communication, during the occurrence of urban protests, a risk assessment. Through the analysis of essays by Non Governmental Organizations (NGOs) and international entities, an analysis of the two criminalization processes is sought, which the subjects, understood in the light of the Touraine concept, were exposed and what role the media play in this context. Among the conclusions obtained, it is worth noting that the media, as an informal agency of the penal system, through a work that does not prioritize the plurality of sources and thus fosters the creation of stereotypes, contributes to a criminalization of the subjects involved in the analyzed events. Moreover, the existence of a criminal policy in place of a criminal policy is seen as an obstacle to the confrontation of discourses of criminal recrudescence based on the creation of enemies.

"Ela não mereceu ser estuprada”: a cultura do estupro, seus mitos e o (não) dito nos casos penais

Women only deserve to be raped in a rape culture. This expression, thought by feminists, is designed and understood to announce the naturalization and normalization of male violence against women, with tolerance and sometimes incitement of, especially, rape, through various behaviors, including distrust around the version of the victim and, above all, their blame for the violence suffered. In this scene, this research intends to answer to what extent this culture manifests itself in the discourses of the agents of the criminal system in cases judged in Pará? Based on criminological and feminist readings on rape, I aimed to analyze the tolerance of rape in the criminal justice system through the analysis of 46 judgments involving this crime judged by the Court of Justice of the State of Pará in the year 2017, in other words, the manifestations of this culture in criminal cases. My hypothesis, therefore, is that the doubling of violence at institutional level in cases of rape indicates the existence of a rape culture in Brazil, which is reaffirmed and maintained by the criminal justice system and which is often manifested in what the judged are silent, and not in what they speak.

O narcotráfico e o sistema penal federal no estado do Pará

The present work is divided into two parts: one general and another specific. We try, in the general part to give a vision concerning to the issue of the use and of the traffic of narcotics and kindred drugs, under their historical and social perspectives, since their origins, in the old times, till the present one. in considering the formation of the great criminal organizations, formed and starting from the growth of the ilicit trade in narcotics and initiated in the first years of this century, regarding mainly to the cocaine traffic and also to the one of the Colombian cartels of Cali and Medellín, created the latter, therefore, since the decade of 1970. It leads us to analyze, in a simplified form, the social issues provoked by the drug traffic, since the conflicts generated in the producer countries of South America, till their present condition in the State of Pará, as a drug runner. It also analyses the Brazilian legislation and the criminologic issues on the question. In the specific part, we investigate the matter, starting it from fieldwork, as a research on the performance of the component institutions of the Penal System at federal level in the State of Pará, whose task is to fight the traffic in narcotics. In order to reach this objective, we stimulated to research, this way, the criminal processes that exist in the judgmentship of the judiciary Section belonging to the Federal Justice in the State of Pará, besides having interviewed the Federal Judges, Republic Procurators and Federal Police Delegates who exercises their activities in the State of Pará, seeking, this way, to make a clear and objective study, concerning to his subject, fundamentally checking the answers once given by the above mentioned institutions (Penal System) in relation to the problem of the ilicit traffic in narcotics and kindred drugs, at an international level, in the State of Pará.

This work entitled "Health Policy and the Prison Population: A Study in State Prison Metro I - PEM I - Para-Marituba" aims to analyze the process of higher health care to prisoners in State Prison Metro I - PEM I - Marituba / PA. For this it was necessary to use the following specific objectives: to investigate the situation of the Brazilian prison system before the picture of social inequality and criminalization; identify how the right to health is structured prison in Brazil, and analyze how the right care health is being materialized as a social right in PEM I. From the perspective of uncovering the object of study methodology was based on the critical approach, using application forms with two (02) inmates who passed health care within the PEM I. Thus, it was established limits and contradictions in health care as a social right of internal PEM I, reflected the precariousness of the right to health in prison.

Reinvenções e permanências do sistema penal brasileiro: a criminalização dos grupos de poder como novo marco de renovação e fortalecimento do controle punitivo

In recent years, the Brazilian criminal justice system has witnessed a movement focused on changing, or expanding, the trend of punitive agencies to punish subjects targeted by their actions. Criminalization processes have been intensified towards subjects whose positions were historically untouched by the punitive justice and, mainly, by the prison system. Such intensification process highlights the need of analyzing and investigating an alleged change in the understanding about the (undeclared) role played by criminal law as instrument used to socially exclude and neutralize unwanted groups. Based on the criminological-critical perspective, we collected and analyzed data about the actions taken by agents participating in control instances involved in the secondary criminalization of people who, despite their political and/or economic power, have been targeted by the punitive justice power for committing white-collar crimes. Factors contributing to the social construction of “criminality” were also analyzed, with emphasis to aspects associated with the public perception about the criminal matter, with the media, with criminal policies, as well as with social, political and economic contexts. The present research enabled reading and understanding about the aforementioned problem by taking into consideration elements of historically-based punitive endeavors. It was possible concluding that the movement witnessed in recent years towards the increased criminalization of individuals who hold political and/or economic power, and commit white-collar crimes, does not represent a punitive turning-point that tends to equal the incidence of criminal interventions. On the contrary, it integrates the logic that has outlined the exercise of punitive power, which was reinvented to suit the criminalized-subject conditions and the contemporary context.

A violência desnuda: justiça penal e pistolagem no Pará

This thesis examines the violent practice of gunmen system in Pará and discusses the selectivity of criminal justice of Para in the face of such conflicts that always culminate with the physical elimination of the victims or result in life on hold the „sworn to die‟, people involved with the land question in Para (pastoral agents, wives and children of rural leaders killed, among others) and they suffer constant death threats by farmers, landowners, loggers and gunmen. It develops from „two major work areas‟: the first throws light on the violence built into the gunmen, then to understand how social relations between gunmen, principals, intermediaries and bring to life the victims of the crimes of command and the latter, in turn, is to discuss the selectivity of the agencies of power involved in the criminalization of the weaker social stratus on one side, and immunization of the criminal actions of the most powerful segments of society on the other. This second front work seeks to explain the impunity in the murders under orders sought by the criminal Para, understood as a set of agencies of power, such as the Civil Police, Prosecutors and the Judiciary.
