The importance of discussing this topic is justified by the need to understand how the educational system has been working the process of guaranteeing rights at this time of the pandemic. To carry out this approach, qualitative research and bibliography research in documents, opinions, articles, and books by authors such as Mantoan (2015), Lima (2016), Hansel, Zych, Godoy (2014), among others were used as a methodological proposal. . The research shows insufficiency in the effectiveness with which educational policies are being veiled in this moment of the pandemic, it points to problems that already exist in education and that with the moment we are experiencing it has only intensified.
