It is an exploratory, bibliographical research, employing a hermeneutic-philosophical method, but with attention to the methodological considerations specific to the philosopher under study, namely those concerning his archaeological-paradigmatic method. The central theoretical framework of this investigation is Giorgio Agamben's political philosophy, particularly in the texts that explicitly address the theme of human rights. However, a broader approach is used in reading and interpreting these texts, delving into the works and authors with whom they engage. The guiding question of this dissertation can be posed as follows: what is Giorgio Agamben’s critical perspective on human rights? Considering that the answer to this question can be approached in various ways, this research focuses on the potential connection between Agamben's critique of human rights and his critique of the ontological tradition of the West. As a general hypothesis, it is proposed that the critique of human rights intersects with a critique of the relationship between living beings and language, within what Agamben calls biopolitics or arcana imperii.
