Acesso em:.https://repositorio.ufpa.br/handle/2011/18200This doctoral thesis, whose title refers to “Criminal Process and judicial scene: analysis of criminal hearings in the Pará Court”, was developed based on theoretical research in the field of Critical Studies of Law, a line of research to which the Author is linked in the PPGD/UFPA, and in observation at hearings in the instruction and trial phase in the criminal procedural field. The problematic issue that gave rise to the discussion presented in this work refers to the observance of judicial practices and how these are being carried out to differentiate the treatment directed at holders of financial capital and those without such capital, in a comparative way between the State Common Justice and Federal Common Justice. The theoretical sport used was critical literature (legal, philosophical and sociological), as a reference for the interpretation of practices observed in legal-criminal hearings. Bourdieu's theory of praxis served to support the discussion on the legal field, as well as Foucault and Agamben's concept of device to understand the Code of Criminal Procedure.
