Law 14.133/2021 establishes objectives for the bidding process, such as ensuring the selection of advantageous proposals for the Public Administration, guaranteeing equality between bidders and avoiding abusive or unfeasible prices. It also aims to encourage innovation and sustainable development. In order to achieve these objectives, the top management of public bodies has been designated as responsible for procurement governance, implementing risk management, internal controls and monitoring processes. In this way, this study proposes an analysis of the new procurement legislation and how governance is related to the context of public contracts through the challenges faced by the State Secretariat for Social Assistance, Labor, Employment and Income (SEASTER/PA), with regard to problems in the preparatory phase of tenders, which involve poor documentary instruction, lack of clarity in the definition of the object to be contracted, coordination between sectors, among others, resulting in delays, inefficiency or redoing of processes. In the search for solutions, it is suggested that integrity mechanisms be implemented, in line with the new legislation and state regulations, in order to mitigate risks and fraud and increase efficiency and credibility in the preparatory phase of these processes.
