This theme emerges from the discussions carried out within the framework of the Observatório Nacional do Sistema Prisional (ONASP) [National Observatory of Prison System] and the debate instigated by the Proposta de Emenda Constitucional (PEC) nº 171 de 1993 [Proposal for Constitutional Amendment], which foresees the reducing the criminal liability from 18 to 16 years for some crimes. Concerning the methodology, it was carried out a survey of documents and data on the Brazilian prison population, young people in fulfillment of educational correctional measure and the country's youth occupation rates.
