    Alternativas penais e democracia: a democratização da justiça criminal pela política de penas e medidas alternativas: um estudo de caso no Tribunal de Justiça do Estado do Pará, 2008-2010

    This dissertation brings forward the results of a social and legal investigation on the democratization process of Criminal Justice, as applied amidst the punishment policies and alternative sanctions in the area of criminal execution. Starting out with the assumption that democratization denotes a process of widening opportunities for participation by the citizenry in public affairs, it is understood that such a phenomenon takes place in Brazilian Judiciary as a function of on-going transformation in the role of Justice which is on course to becoming a public space where citizens tend to ever more dramatize social and inter-subjective relationships through the language of law, especially in the realm of fundamental rights. As though that was not enough, the judiciary community is also aware nowadays, in some segments, of certain frameworks in which citizens alien to the legal field have started to partake in the process of judicial interpretation and decision-making, thus extending the circle of players enabled to speak on the law, whereas such an initiative was formerly monopolized by professional jurists, mainly magistrates and by the courts. One such venue seems to be the execution of punishment alternatives in Brazil, and this is so because the National Policy on Punishment and Alternative Measures, inspired by the Tokyo Standards, has fostered the adoption, within the Judiciary, of equipment and public services for execution of punishment and alternative measures which imply, on one hand, the spreading through the legal field of concerns of political and social nature with fundamental rights of the enforcers and, on the other hand, the opening of punishment execution to participation by professionals of nonlegal areas and by community cells involving definition, overseeing and monitoring of punishment alternatives, including the availability of wider opportunities for enforcers to express their opinions and formulations on crimes, penalties and such measures. Within the dissertation reach, such a democratization framework is investigated as from the experience of the Court for Punishment Execution and Alternative Measures with jurisdiction over the Metropolitan Area of Belém, before which an empirical survey was carried out with the purpose of grasping, mainly, the standpoint of Agents of the Judiciary, notably of those working with execution of punishment and alternative measures, to the extent that the legal, social and political burden of performing within the arena of punishment alternatives goes, under a perspective leaning towards democratization in the judicial field.

    Ciência, cientistas e democracia desfigurada: o caso Belo Monte

    The hydroelectric frontier in the Amazon is expanding due to the construction of large projects such as Santo Antonio and Jirau in the Madeira River, proposed projects in the Tapajós River, and Belo Monte in the big bend of the Xingu River (licensed in February 2010). Large projects that generate energy in the Amazon region provoke political, social, and environmental confl icts. These confl icts affect the credibility of the Environmental Licensing Evaluation process. Discourse from social groups that oppose development policies for the Belo Monte Hydroelectric Dam project offer insight into the origins and progression of these confl icts. Criticisms of the Experts Panel Network created to analyze the Environmental Impact Assessment in Belo Monte and other sectors of the society are evaluated.

    Comunicação, neoconservadorismo e reconhecimento: tensões, contradições e disputas acerca das noções de família no Brasil em ambientes de visibilidade ampliada

    The democratic crises and political ruptures marked by the 2016 coup, which polarized the public debate in Brazil, showed us that the notions of family have guided contemporary discussions, especially when tensioned from the advances in the struggles for recognition taken up by the LGBTQIA+ populations and of women, through the feminist gender debate. In different spaces, we were able to witness the mobilization of the concept of traditional, or nuclear, family, as a resource for coping with social changes arising from the visibility of other relationships and ways of being and living. At the same time, we also see in debate arenas the assertion that, as a historical-social construct, the family entity is mutable and diverse. In this context, we ask ourselves: what arguments are put forward in the public sphere to defend one or another way of dealing with the issue? And how do the media act in this context? These questions instigated this research. Our general objective in this work is to understand how the notions of family guide the contemporary political debate from the tensions arising from the action of social movements and the meanings produced about the family category in the media. Specifically, we want to a) Identify which senses/notions and arguments about family emerge in different communicational contexts; b) Identify which contemporary landmarks are decisive for the debate on families in the political agenda; c) Understand what notion of politics or democracy underlies discourses about families and what elements/characteristics/aspects of the family entity are in dispute; f) Understand how social movements from different political spectrums (conservatives and progressives) build their political agendas around the family category. For this, we focus on a theoretical framework to understand the elements that led to the rise of the extreme right in western democracies, the convenient partnership between neoconservatives and fundamentalist Christians, especially evangelicals, and the strength of neoliberalism operating as rationality in social relations. In addition, we seek to understand the role of the media in inserting themes for discussion in the public sphere and how social movements appropriate environments of increased visibility to reverberate their agendas. The corpus of analysis consists of texts published on the news portals O Globo and Estadão; and the content of progressive (ABRAFH and Aliança LGBTI+) and conservative (Instituto Plínio Corrêa Oliveira and Movimento de Defesa da Família) sites. To answer our questions, we developed a Content Analysis with technological support from the Iramuteq software, which helped us to systematize the data. For each dimension, we established categories based on the Descending Hierarchical Classification (CHD) derived from the Reinert Method, produced by the software. The categorization allowed us to understand the available arguments about families that deal with the defense of a rigid structure, which contributes to the maintenance of traditionality and an expanded notion of family.

    This dissertation work has as its title: Political Culture in the Management of SUAS: a study in small municipalities of Pará is a qualitative research, where the methodological procedures used were: bibliographical and documentary research, interviews focus groups, semi-structured interview, participant observation and content analysis. The empirical universe of this research, through the direct contact with four segments of subjects in the context of SUAS distinctly identified, are: Managers; Counselors; Technicians and Users of the Social Assistance Policy of the municipalities of Salinópolis - PA and Inhangapi - PA, both municipalities chosen to be part of the Regional Survey EVALUATING THE IMPLEMENTATION OF THE SINGLE SYSTEM OF SOCIAL ASSISTANCE IN THE NORTH AND NORTHEAST REGION: SUAS meaning for coping with poverty in the poorest regions of Brazil, which is part of the National Survey EVALUATING STUDY OF THE IMPLEMENTATION OF THE SINGLE SYSTEM OF SOCIAL ASSISTANCE IN BRAZIL, through this study, we seek to understand the Political Culture implicit in the management process in small municipalities and how, after nearly two decades of implementation of SUAS, understandings, attitudes, and practices in the operationalization of social assistance policy still reflect non-democratic principles of a non-citizen political culture. The reality of the research was to identify patterns of an undemocratic and non-citizen political culture, whose predominant brands are expressed through patronizing, paternalistic, assistentialist, subalternizing and poverty servility practices, which are observed with greater expressiveness, especially in the a municipality where the "first-damismo", occupying the management of SUAS, exercises domination and cooptation in a veiled way, validating the political order, and materializing non-politics, under the "pseudo" caricature of the state.

    Democracia e eleição de dirigentes escolares no sistema municipal de ensino de Belém: análises e perspectivas

    The research was turned toward the inquiry of the institutionalization process of the direct election of pertaining to school controllers in the Municipal System of Education of Belém, as dimension of the projects pedagogical politicians and produced by the municipal managements in the period of 1993 the 2006. The objective was to analyze the advances, limits and perspectives of the proposals of election of controllers, established under the optics of the plan of the deed of division-legal orientations of the educational system. The used methodological orientation was of the bibliographical research and the documentary analysis. Through a detailed study of main official documents produced by the municipal administrations, it was intended to identify to the scienters politics of the respective governments in the delimited period and to characterize its respective educational projects and proposals of election of pertaining to school controllers, as well as perceiving the conception of democracy and inherent democratic management to the same ones. The results reached with the inquiry in take them to infer that the process of democratization of the pertaining to school management in the SME, saw the election of pertaining to school controllers, is not something finished and defined, but a permanent construction, marked for gone and comings, jibs and advances, that point with respect to distinct perspectives and horizons and reach the most different ideological shades. Therefore, it can be affirmed that the pertaining to school democracy in the SME is not, but is being constructed in accordance with to the possibilities and constaints presented at each historical moment and with the capacity of the educational actors to incorporate the established institucional democracy.

    Democracia, poder majoritário e contramajoritário: o debate teórico sobre a revisão judicial

    Democracy in the modern world means legitimacy for government coercion over individuals. The advent of fundamental rights and judicial supremacy put a brake into the majority impulse. Critics argue that allowing judicial supremacy overlap the popular will, it is denying to the people their self-determination, and consequently, denying democracy either. This research has as its context in the Proposed Constitutional Amendment nº 33 - PEC 33 which refer to the theorical debate between judicial review and political legitimacy in a democracy. This work aims to analyze majoritarian, deliberative and constitutional theories of democracy in order to justify the role of judicial review on the last word about the fundamental right's protection. This study argues that political legitimacy before coming from public will of selfdetermination goes through the best defense of fundamental rights and human dignity of individuals, so on, consequently when judicial review protect rights over the collective will instead of affronting democracy, end up showing the best concept of what democracy should be.

    This study investigates the portals of state governments in the Amazon , sando saw the realization of e-government movements who want to deepen democracy through digital processes. The investigation was conducted in six states portals Amazon. The analysis model encompasses, on the one hand, the most technology and how these portals are providing information to citizens aspects in order to create facilities and opportunities for their lives. And secondly - and this is the most important aspect - those relating to accountability and popular participation. All this has the sense to see how the portals have been constituted as an instrument to deepen democracy in the Amazon states and realization of a new type of society: the digital. The theoretical model undertakes categories of e-government, accountability and popular participation. The results are not encouraging, also converging with international experience. What is observed is that the portals, in general, have adequate technological resources, there are conditions of good navigation, information search. Thus, the technology does not seem to be a problem. What portals resent really is greater interactivity, it can be inferred that the relations established are fundamentally the government-to-citizen type, with the government issuing and society, it seems, the receiver liabilities, while away the inversion of this relationship for citizen-to-government.

    Educação e democracia: um estudo comparado entre o pensamento de Paschoal Lemme (1904-1997) e o de Anísio Teixeira (1900-1971)

    This dissertation study aims to focus on the relationship between education and democracy at the thought of Paschoal Lemme (1904-1997) and Anísio Teixeira (1900-1971). The problem and the issues that guided the research, respectively, were: What relations are possible grasp of the concepts that Paschoal Lemme and Anísio Teixeira historically built by linking education and democracy? What is the intellectual itinerary and life of the authors? What theoretical bases underlied the thought of Paschoal Lemme and Teixeira to articulate education and democracy? What is the relationship established between education and democracy at the thought of each author? What similarities and differences exist in the thought of Paschoal Lemme and Anísio Teixeira in the relationship between education and democracy? The general objective was to analyze, through the Cultural History and Comparative Study of intellectual thought, possible relations between the conceptions of Paschoal Lemme and Anísio Teixeira on education and democracy, identifying congruence and differences. And the specific ones: Reconstitute the itinerary and intellectual life of each author; Describe the theoretical basis underlying the thinking of the authors; Rebuild relations which the authors established between education and democracy; Infer results from the points of divergence and convergence in the thinking of authors when dealing in their works the relationship between education and democracy. Methodologically, it is a bibliographical and documentary type of search, located within the area of History of Education, with basis in Comparative History, New Cultural History and Intellectual History. The objects of analysis were the books "Educação Democrática e Progressista (1961)" and "Educação na URSS (1955)" by Paschoal Lemme. The other books were "Educação no Brasil (1969)" and "Em marcha para democracia: à margem dos Estados Unidos (1934)" by Anísio Teixeira, as well as correspondence. Paschoal Lemme and Anísio Teixeira stood out for his work in Brazilian public education in the twentieth century. Paschoal Lemme and Anísio Teixeira saw education as a social process and the school as a fundamental institution for the development of individual potential of every being. However, Anísio Teixeira believed in the democratization of education as a potential factor to transformate the society, while Paschoal Lemme argued that the democratization of society pervaded by changing the economic and political system so as to democratize education. Some of the points of convergence between Anísio Teixeira and Paschoal Lemme are: They acted together in ABE; They defended the right to a public, secular and democratic education; both of them had the spirit of freedom and humanity. The greatest thought divergence of both is related to the ideal of democracy, while Paschoal Lemme was socialist, Teixeira was a liberal-pragmatic.

    Entre eleitoras e elegíveis: as mulheres e a formação do eleitorado na democracia brasileira - quem vota? quem se candidata?

    This proposal examines the making of the Brazilian electorate through analysis of the country's constitutions and electoral laws, as well as a specific historical literature, noting how Brazilian citizens - women and men - are considered as voters and as eligible persons, as well as the legal training related to party affiliation. This approach sheds light on forms of exclusion and inclusion that affect Brazilian women, women's strategies in overcoming legal discrimination, and the political achievements that paved the way to access to formal education, to diverse careers and to the revision of the Civil Code. Gradually, the barriers to women's political participation were removed, following the complaints of feminist movements and literate women who agitated for legal reforms and for the constitutional guarantee of their rights. Authoritarianism and democracy alternated during the republican years, giving rise to changes in Brazil's electoral rules which recognized the status of women as voters and as eligible for office. Primary (constitutions, electoral codes and the statutes of the current parties) and secondary sources were used to evaluate the development of political citizenship (active and passive), the making of the electorate (right to vote and to be a candidate), of candidates with no party ties (during the Empire) and within the parties (affiliations) after the founding of the Republic.

    O Estatuto da Criança e do Adolescente em discursos autoritários

    It is with this article question the ownership of the Statute of the Child and Adolescent in power and know practices driven by populist policies and authoritarian soon after the promulgation of this code, at the inauguration of the Ministry of the Child. These speeches, is the then President of Brazil in the period, Fernando Collor de Mello. Through a historical and genealogical methodology of Michel Foucault and theoretical contributions of anthropologist Marilena Chauí, analyzes the speeches that built the children and young people as the goal-Brazilian synthesis of the New Republic. These actors idealized in the Statute of the Child and Adolescent symbol of the entry of Brazil in civilization and modernization, in an illustrated design of Law as a mechanism of progress and development of a nation. These practices they tried to delete, by means of games of be able, the struggles of movements socials in advantage from claim of rights of children and adolescents.

    The following text presents a research carried on the Ombudsman Office of the Federal University of Pará, in the period 2006-2012, aiming to investigate the way that that office has been performing its duties and responsibilities, in the relationships amongst the university community. In order to achieve these goals, it has been determined the exploratory descriptive research as the methodological procedure, as well as the bibliographical and documentary modalities. Authors such as Rousseau, Schumpeter, Lyra, Vilanova and others, were used to define concepts of analysis, such as: state, democracy, public ombudsman. As a result of that research, it has been exposed some initial considerations that express the importance of the Ombudsman Office of UFPA for the university community, perceived as an instrument of mediation and democratization of access, in the search of the efficiency of the services offered by the institution.

    A exigibilidade judicial dos direitos sociais

    The lack of concreting of some fundamental rights, as social ones, related with health and education, wich demands costs to State, still represents a challenge to brazilian constitucionalism. In consequence, Courts are facing with issues related with the materialization of suth rights, as supply of medicines that are not able on public healths system or a guarantee of matriculation of an student on public education system. These requests of judicial orders directed to public administration to fulfill its constitucional duty, throught positives obligations. Such phenomenon, included for the great part of doctrine on what its used to call as "judicialization of politics" is not free from criticisms. Against it, there are arguments that (I) Judiciary is assaulting the separation of powers principie because the administrative function with its discricionarity, must be preserved with Executive, and not on judges hands, who are forbbiden to interfer in public politcs; (II) judges have no democratic legitimacy, because they were not elected by the people; (III) Judiciary is not prepared and technicaly capacitaded for such kind of demand; (IV) depending on positives state behavour and public recourse for its concreting, a judicial determination in this way would oppose legality and budget anteriority principies, finding serious obstacles in its concreting because the "possible restriction". This study proposes not only to analize these related arguments, as also examinate borders of juridical and political systems, concluding legitimacy or not of such conduct, as well to analyse the nature, the programatic caracter and the dificult delimitation of social rights and its judicial protection, in others words, seaching, in resume, to examinate brazilian Judiciary function on social rights concreting problem, as "existencial minimum" warranter.

    This work is part of the field of historical education insofar as it is concerned with the results obtained in the training process of young people and adolescents, especially in what is related to the preparation for the exercise of what we define as active citizenship. In it, we provide a brief history of the role of the formal school in the process of inclusion of new generations in the cultural environment of each period. Taking as a reference what was positive about education in the Federal Constitution of 1988 and in Law 9,394/1996 (Law of Guidelines and Bases of National Education), we elaborated and carried out a qualitative research with students entering the integrated high school courses of the IFPA Campus Bragança in order to observe and analyze their citizenship formation. In addition to this citizenship education, we also seek to observe and analyze some elements present in the historical awareness of these students, given the intention to develop methodologies in order to make historical learning more meaningful and capable of providing temporal guidance for students.

    Gestão democrática da política urbana: mecanismos participativos na esfera local

    This paper aims to discuss the democratic management of urban policy. In this context, it is about the evolution of the concept of democracy, especially related to the representative democracy and the participative democracy. For this, it analyzes the wide number of participative instruments which are applicable to urban management, not only those that were established directly by the Federal Constitution, but also those derived from it. Such instruments are constant in the subconstitutional legislation, especially the City Statute. In addition, it analyzes the elaboration process of the Director Plan of Belém, revealing what has gone right and the difficulties about adopting participative mechanisms in the urban universe. According to this, it is relevant to check the relations of power currently in the city, especially concerning the exercise of the local power nowadays, when the globalization has been altering the cities’ profiles. It opens the debate about the range of acting in the local decisionmaking power.

    Participação social junto ao orçamento público municipal: os casos de Capanema, Cametá e Marabá no Estado do Pará

    Social participation in Brazilian democracy was greatly boosted by the promulgation of the 1988 Constitution. Organized civil society gained momentum with the implementation of a new legal system that introduced popular participation on various topics, especially those that were referred to control as national and subnational public policies. Health, education, environment and public budget were some of the areas covered with items that standardized social participation definitively, in an attempt to bring the population closer to government planning and actions that directly affect the lives of all citizens. However, legal and normative support does not mean changing the profile of centuries of delays and setbacks that have always marked social participation in public policies in the country. Patrimonialism, slavery, successive dictatorships, submission and dependence of the poorest to the excesses of local governments, are still profound marks when it comes to expanded popular participation, as is the case of the Municipal Public Budget, where effective participation social is very far from a plausible reality, available executable or even close to the population, despite being one of the most important public policies at the municipal level, the target of this research. The theories that supported this research lead us to the concept of Deliberative Democracy and the formation of a Public Sphere by Jürgen Habermas, and the Social Construction of a Subcitizenship in Brazil by Jessé Souza, together with social participation in the Municipal Public Budget of Cametá, Capanema and Marabá in the State of Pará, more specifically analyzing an interaction between representatives of organized civil society in municipalities, Unions, Councils, etc., and as Municipal Secretaries of Administration or Planning, responsible for preparing the budget, organizing and carrying out Public Hearings for the debate of the Budget Guidelines Law (LDO) with local population, according to the Municipal Council of Councils that approve and supervise the budget of the municipalities and the Controllerships of the Court of Accounts of the Municipalities of Pará (TCM-PA), which oversee and budget execution of the municipalities from Pará. The main objective was to analyze how social participation happened with the municipal budget of Cametá, Capanema and Marabá in 2020, taking into account the role of the State, represented by the municipal executive and legislative power, and representatives of civil society, in the attempt to understand the apparent process of submission and apathy of the local citizen when preparing and approving the public budget by the municipal government. To carry out the research, the following methodological procedures were used: a) theoretical and conceptual bibliographic review of the theme; b) Analysis of the Pluriannual Plan, the Budget Guidelines Law and the Annual Budget Law of the surveyed municipalities; c) conducting individual interviews recorded with semi-structured questions with representatives of organized civil society, secretaries and municipal technicians, councilors of the budget and finance commissions of the surveyed municipalities, coordinators and technicians of the TCM-PA Controllerships responsible for the surveyed municipalities; d) Data analysis and systematization. The result explains the distancing of representatives from civil society from the public budget approved for 2020, the non-compliance with the legal rules for effective participation by city halls with the collusion of city councils and the neglect of TCM-PA regarding compliance with the rules constitutionally provided for the item Social Participation.

    This thesis aims to answer the question: Can the police be democratic? Therefore, it analyzes the connection between the concepts of police and democracy, and performs the separation of a police lato sense and other strict sense. After, realize the importance of the criminal justice system and some speeches to make stronger an ideology focused on the segregation of individuals previously established. Defends the necessity of a democracy guided for equality in order to gain an emancipation of domestication imposed and a possibility of a democratic action by the police. The results confirmed the impossibility of lato sense police be democratic. Advocates the need to believe in the possibility of a dissent and that all are free and equal to join him or not.

    Política educacional na cidade: limites e perspectivas na implementação do plano municipal de educação em Igarapé-Miri

    We place this study in the subgroup of educational policies that bears the title Educational policy in the city: limits and perspectives in the implementation of the Municipal Education Plan in Igarapé-Miri/Pará. The focus issue was how the Municipal Education Plan (PME) contributes to the democratic management of public education in the city of Igarapé-Miri/Pará? The objectives that led the study were: to investigate the theoretical framework about democratic educational management as a public policy represented by the PME, to describe the democratic management of education, through the implementation of the PME in the city of Igarapé-Miri/Pará and to verify whether the PME contributed to the democratization of educational management in the city of Igarapé-Miri/Pará. The main references that supported this production were classic authors, such as contractarians, and modern authors such as: Becher; Raveloson (2011), Bordenave (1994), Dourado (2001,2018), Lück (2009,2011), Muller; Surel (2002), Paro (1998,1999, 2007,2011), Saviani (2014), institutional publications and legislation. The adopted methodology was bibliographical, documental and the case study essay. Data analysis showed that the goals of the PME, such as the democratic management of public education, were not implemented, since the municipal public power of Igarapé-Miri did not offer the adequate infrastructure, such as the creation of collegiate bodies or the financial allocation for this, thus the main contribution of the PME is its legal existence, which brings in itself the perspective for its future realization.

    The main objective of this article isto discuss the State-Society relationship and governability, governance and accountability actions as contemporary challenges to Brazilian democracy. To achieve this objective, the article usedexploratory-qualitative research methodology. The main conclusion is that creating, disseminating and implementing improvements in the effectiveness of governability, governance and accountability strategies are essential for the maintenance of democracy and the strengthening developmentin Brazil. This is because the consolidation of democracy that achieves governability in Brazil must be thought of in direct connection with a true national project of development and reduction of socioeconomic inequalities. In fact, the democratic consolidation that achieves good governance and governance in Brazil, without deviations from planning or ideological rhetoric, permeates the need to improve its accountability. It is, therefore, a slow and gradual advance towards a more evolved society that is “aware” of what is important to improve democratically as a nation.
