Direito à moradia nas políticas públicas de enfrentamento à violência doméstica contra as mulheres negras

Abstract

This dissertation sought to verify the dynamics between the right to housing and national regulations to combat domestic and family violence against women, focusing on black women. This is an exploratory and bibliographical research, whose method of approach was hypothetical-deductive, using bibliographical and documentary research techniques. With the completion of the bibliographic and documentary survey, the data was selected and analyzed using the content analysis technique. In this sense, the guiding research problem was: How do national regulations for combating domestic and family violence against women address the right to housing? Thus, the hypothesis was that the right to housing does not receive due attention in mechanisms to protect violence against women, such as the Maria da Penha Law, which directly impacts the quality of life of those targeted by some form of rape, especially black women. the general objective was to analyze how national regulations for combating domestic and family violence against black women deal with the right to housing, while the specific objectives were: a) to identify national regulations for combating violence committed against women; b) evaluate how the right to housing directly impacts the lives of black Brazilian women; and c) reflect the effects of domestic violence in relation to the effectiveness of the right to housing. In this way, the research sought to provide a historical overview of the land situation in Brazil, in order to understand black women's access to housing. Furthermore, a historical resumption of public policies to combat and confront domestic violence was carried out, with the purpose of verifying whether the right to housing and the racial marker have been highlighted in documents that deal with the protection of women.
