dc.description.abstractThe objective of this study is to answer the following question: is it appropriate to suspend individual lawsuits in the face of an essentially structural collective macro litigation action? This research hypothesizes that the structural collective process, given its characteristics – namely, multipolarity, complexity, and procedural flexibility – makes the desired institutional restructuring an excellent way for debate and change of reality, including the possibility of suspending individual lawsuits that have the same underlying discussion. The research is justified because, although there are already doctrinal discussions and binding precedents authorizing the suspension of individual cases in the face of collective macro-litigation, none of these debates encompass the topic of structural injunctions. To address this issue, the thesis is divided into six sections, the first and last ate the introduction and conclusion, respectively. The second section seeks to delve deeper into the topic of structural injunctions, conceptualizing them and addressing their main general issues. The third section analyzes the solutions – consensual, adjudicated, and shared, deepening the themes. The fourth section analyzes the binding precedents of the Federal Supreme Court (General Repercussion Theme n. 675) and the Superior Court of Justice (Repetitive Themes n. 60, n. 589, and n. 923) that authorizes the suspension of individual actions in the face of collective macro-litigation. The fifth section seeks to apply the logic of the studied precedents, analyzing the appropriateness of suspending individual actions in favor of structural macro-litigation. This thesis concludes by stating that, yes, the suspension of ongoing or future individual actions is appropriate when a structural collective lawsuit is being planned, addressing the same issue. Individuals have the right to file their mass lawsuits; however, if there is the substantive dispute in a collective and structural injunction, the latter should be prioritized, and the Judiciary should strive to resolve it in a timely manner, suspending individual lawsuits in favor of the principles of efficiency, procedural economy, equality, and reasonable duration of the process.
dc.description.resumoO objetivo do presente estudo é responder à seguinte questão: é devida a suspensão das ações individuais diante de um macro-lide coletiva essencialmente estruturante? Levanta-se nesta pesquisa a hipótese de que o processo coletivo estrutural, dada as suas características, quais sejam, multipolaridade, complexidade e flexibilidade procedimental, tornam a recomposição institucional pretendida, uma excelente via para debates e modificação da realidade, inclusive podendo suspender as demandas individuais que tenham a mesma discussão de fundo. A pesquisa justifica-se, pois, apesar de já existirem discussões doutrinárias e precedentes vinculantes autorizando a suspensão das causas individuais diante da macro-lide coletiva, nenhum destes debates perpassa a temática dos processos estruturais. Para responder tal problema, a tese se divide em seis seções, sendo a primeira e a última, introdução e conclusão, respectivamente. A segunda seção busca aprofundar a temática dos processos estruturais, conceituando-os e tratando de suas principais questões gerais. A terceira seção busca analisar as vias de solução, quais sejam a via consensual, adjudicada e compartilhada, aprofundando os temas referentes. A quarta seção analisa os precedentes vinculantes do Supremo Tribunal Federal (Tema de Repercussão Geral n. 675), e do Superior Tribunal de Justiça (Temas Repetitivos n. 60, n. 589, e n. 923) que autorizam a suspensão das ações individuais frente a macro-lide coletiva. Na quinta seção busca-se aplicar a lógica dos precedentes estudados, analisando o cabimento da suspensão das ações individuais, em prol da macro-lide estrutural. Conclui-se a presente tese afirmando que, sim, é devida a suspensão das ações individuais em curso ou a serem propostas, quando estiver tramando um processo estrutural coletivo, que verse sobre a mesma temática. Os indivíduos têm o direito de propor suas demandas de massa, contudo, havendo a discussão de fundo em lide coletiva e estrutural, esta deve ser privilegiada, devendo o Judiciário se esforçar para solucioná-la em tempo hábil, suspendendo as demandas individuais em prol dos princípios da eficiência, economia processual, igualdade e razoável duração do processo.
