That phenomenon of judicialization of public life has occurred in Brazil, specially after the promulgation of the 1988 Constitution. The parties of the Justice System started to have major influence upon the social, economical and political context of the country, working on the enforcement of new rights and the shaping of public agenda. In view of such context, this dissertation analyzes the judicialization of politics in the Brazilian political-institutional circumstances, delimiting, however, its scope to working into the Federal District Attorneys in the Stated that compose the Legal Amazon on conflicts of a group nature, seeking to understand, fundamentally, the judicial and extrajudicial ways to mediate conflicts, the criteria for the institution actions over this type of controversies, as well as the outcome of those actions and relations with the Justice System. The central idea is that the mechanisms which favor inclusion in the justice system can play a major role in the enforcement of rights and the shaping of public agenda.Item Acesso aberto (Open Access) A atuação Política da Coordenação de Proteção dos Direitos dos Povos Indígenas e das Populações Tradicionais (CPPITA) na Secretaria de Justiça e Direitos Humanos (SEJUDH)(Universidade Federal do Pará, 2013-07-10) GOMES, Izaquiel Mateus Macedo; ASSIS, Eneida Corrêa de; http://lattes.cnpq.br/7712390425145521Institutions that deal with indigenous issues are present in the political scene, mainly from the Indian Protection Service (SPI), a posteriori, the National Indian Foundation (FUNAI) these national imprint. The indigenous issue in the state of Pará gain some visibility in the municipal government with the mayor of Bethlehem Edmilson Rodrigues (1997-2000, 2001-2004) and then with the Governor Ana Julia Carepa (2007-2010). Given the reforms the state executive, the Department of Justice becomes Secretary of Justice and Human Rights, which congregate demands of various political minorities between her coordination that deals with the protection and the rights of indigenous and traditional populations in which an indigenous came forward during the rule Ana Julia. Although space favored by the government Ana Julia was not possible to effect a state Indian policy seeking to understand the topic in local terms, there will be a historical review of the relationship between state and Indians in order to provide a framework DAS questions that have guided the dialogue in institutional aspect. The investigation was conducted in six states portals Amazon. The analysis model encompasses, on the one hand, the most technology and how these portals are providing information to citizens aspects in order to create facilities and opportunities for their lives. And secondly - and this is the most important aspect - those relating to accountability and popular participation. All this has the sense to see how the portals have been constituted as an instrument to deepen democracy in the Amazon states and realization of a new type of society: the digital. The theoretical model undertakes categories of e-government, accountability and popular participation. The results are not encouraging, also converging with international experience. What is observed is that the portals, in general, have adequate technological resources, there are conditions of good navigation, information search. Thus, the technology does not seem to be a problem. What portals resent really is greater interactivity, it can be inferred that the relations established are fundamentally the government-to-citizen type, with the government issuing and society, it seems, the receiver liabilities, while away the inversion of this relationship for citizen-to-government.Item Acesso aberto (Open Access) Entre as urnas e as togas: Justiça Eleitoral e competição política no Pará (1982/1986)(Universidade Federal do Pará, 2012-09-11) BITTENCOURT, Jean Guilherme Guimarães; SIQUEIRA, Edir Veiga; http://lattes.cnpq.br/9176462002883343In this work, we analyze the electoral governance exercised by the TRE-PA (Electoral Regional Court at Pará State, Brazil), particularly its exemption level in electoral disputes concerning elections to the governor and senator, 1982 and 1986, with hindsight the period 1945 to 1965 - the first time to work continuous and prolonged of Electoral Justice system in a democratic context, before the Military Coup of 1964. We assume according to which, given the peculiar composition of the Electoral Justice system, which works borrowing judges from common law courts, and the Regional Electoral courts composed mostly of members of the state courts of justice, coupled with the pattern of relationship executive-judiciary state system, historically characterized by the subordination of the second by first power, there is a high probability of favoring the TRE/PA to majority candidates (Governor and Senator) of the ruling party, a circumstance aggravated by the historical period in depth, considering the massive interference of the state executive power on its judiciary, observed previously the promulgation of the Brazilian Constitution of 1988. However, although there is strong evidence to corroborate this hypothesis in the period 1945-65, we found no evidence to support it during the elections of 1982 and 1986. In 1982, the TRE showed a reasonable degree of impartiality and consistency in their judgments, except in two similar cases: one caused by the PDS and the other by the PMDB, both involving a significant number of votes. The PMDB party, sponsored by the then governor, won the deal, while the PDS, the opposition party, was defeated. With regard to the election of 1986, we observe a provision of the court to deny the requests proposed by the legends opposition, especially the PT and PMB extinguished, although it is not possible to demonstrate a clear bias to the ruling party.Item Acesso aberto (Open Access) Formação e renovação dos governos do Pará: elite governamental e grupos políticos (1983-2006)(Universidade Federal do Pará, 2012-09) SOUZA, Márcio Ivan Lopes Ponte de; FARIAS FILHO, Milton Cordeiro; http://lattes.cnpq.br/0624491756992741This study aimed to identify who are the central Government Elites who composed the Governments of Pará between 1983 and 2006 from the analysis methodology proposed by the Theory of Elites. Our object of study documents titled Terms Posse, filed with the State Department of Administration (SEAD), which record the appointments of Secretary of State offices and the like. Using the method of Institutional Position has detected a Political Group formed from the composition of each Government investigated and, of this group, are selected names that were included in other Governments, called “elite lasting”. Each member of this latter group corresponds to a Connection which can be from two, three, four or more administrations. Analyzing these data in light of elitism, produced a “Elitization Index” (IE), which compares how much each Government produced, percentage of names that formed the “elite lasting”.Item Acesso aberto (Open Access) A imprensa e a política no Estado do Pará nas eleições majoritárias de 2010: atores, interesses e conflitos(Universidade Federal do Pará, 2012) CATETE, Karlla Gyselle Souza; SOUZA, Carlos Augusto da Silva; http://lattes.cnpq.br/7158504535308341The comparative analysis of editorial behavior of the two most relevant newspapers of the state of Pará – O Liberal and Diário do Pará – at the coverage of state government election and federal senate in 2010 was the main focus of this study, because of the rivalry and divergence that mark the relationship between these companies regarding political support to candidates and parties at local elections. This observation has intrigued us to verify if the companies used resources and/or strategies in favor o for against, through published information, groups to which they are aligned or reject, aiming to create a positive and/or negative perception of the candidates from the electorate. It also made us analyze if the creation of the law known as “Ficha Limpa” – Complementary Law nº. 135/2010 – has produced different conduct of the newspapers, trying to reach the elector, considering that, in Pará, two candidates to senate could have had their registration repealed if caught by this law – Jader Barbalho, from PMDB, and Paulo Rocha, from PT. The few editorial groups in order to inform the voter, are analyzed from the perspective of what Wanderley Guilherme dos Santos in "Poliarquia in 3D," called "oligarchyzation of the information”. It concludes that the media had no role in the choice of voters in the election of 2006. They continue to influence, but without the weight of old, just from the voter's choice to seek other sources of information outside of "the media oligarchy" and democratize their vote choices.Item Acesso aberto (Open Access) Movimento social indígena e participação política: a contribuição da COIAB na formação de lideranças(Universidade Federal do Pará, 2012-10-22) OLIVEIRA, Andreici Marcela Araujo de; ASSIS, Eneida Corrêa de; http://lattes.cnpq.br/7712390425145521As the Brazilian indigenous movement gained prominence after the 1988 Constitution, the emerging political leaders of indigenous organizations need to coalesce their struggles and express a politicized ethnic identity among the various instances to government that their demands are met. Accordingly, the aim of this study is to investigate the political participation of COIAB focusing on the formation of political leadership. To meet this goal, the analysis of the indigenous movement in the Brazilian political scene post-88, the formation of political leaderships COIAB such as training courses, their target audience, so entry and exit and the actions of COIAB political leaders are steps necessary to understand the political process of this indigenous organization. The dynamics of the indigenous movement, a new form of inclusion in the political process in making decisions reflect the need for an increasingly broad articulation. COIAB can play a major role when it comes to indigenous political activism. Expressed thus an ethnic identity that aggregates all these values struggle of the Indigenous Movement as the search for an affirmation of identity, empowerment of indigenous leaders, as well as active participation.Item Acesso aberto (Open Access) A percepção dos jovens sobre valores e sistema político: estudo comparativo entre municípios novos e tradicionais(Universidade Federal do Pará, 2010) SOUZA, John Assunção de; HENKEL, Karl; http://lattes.cnpq.br/0986009640436799The present work through the methodology of quantitative research, conducting a comparative study on differences in values and ideas of the population about the political system, the state, democracy, participation and political representation in the municipality of Paragominas receiving influences of immigration various social groups which was founded by a population of origin of the Midwest mainly south and northeast Brazil during BR 010 (Belém-Brasília) who encouraged the migratory flow to the region during construction the process of colonization of the Amazon, and Cametá no migratory flow and so recognized as belonging to the municipality and traditional oldest municipalities of Pará state whose origin is from the colonial period but that, like Paragominas, belongs to the municipalities of medium-large. However, Cametá has an economy based on agriculture and is spatially more isolated and distant from the axis of development. A method applied was the completion of the survey in high schools where there is a concentration of people has allowed for cluster sample among students aged 16-24 years old.Item Acesso aberto (Open Access) As perspectivas políticas da criação do Estado de Carajás a partir do ponto de vista das representações parlamentares municipais(Universidade Federal do Pará, 2012-12-17) MORBACH, Maria Conceição Bezerra; SILVA, Dolores Lima da; http://lattes.cnpq.br/7277148176512169This study addresses the prospect of creation of the state of Carajas from the point of view of parliamentary representation of municipalities in the south and southeast of Pará Theories about political representation and criticism of elite theory guided the analysis, since the theme of redivision of territory Para has inflamed speeches by political candidates and campaign during the referendum of December 2011 the debate was reversed in multiparty animosity between the fronts of yes and no, the opponent's claim against the emancipation, which division it was a political project of local elites. Empirical basis of the field survey was administered to the 39 council districts in the region. The research revealed that regionalist political mobilization is anchored in the decision-making power away to leave the area outside the government agenda and emphasizes the oblivion of public power state. The councilors see the new state as a possibility to meet demands for public policies and employment opportunities and income, but clearly perceive an opportunity to grow their careers and policies to increase parity in the balance of representation from the north in Congress.Item Acesso aberto (Open Access) O planejamento territorial participativo do Pará e o processo de formulação, implementação e tomada de decisões de políticas públicas: inovação e limites para a democracia participativa(Universidade Federal do Pará, 2012-10-19) MESQUITA, Thiago Broni de; SILVA, Dolores Lima da; http://lattes.cnpq.br/7277148176512169By taking the state government of Pará in 2007, the then Governor Ana Julia Carepa (PT) presents the Participative Territorial Planning which was an instrument through which the Government of the State of Pará aimed to ensure popular participation and decentralization of management, through steps where the population was consulted on issues and public policy proposals advocated local or regional. These proposals were incorporated into the statutory planning instruments (PPA, LDO, LOA) for the government to implement over the 04 years of management. The process involved the participation of more than 80,000 people across the state and elected councilors to compose 3983 12 Regional Councils of Popular Participation and more Counselors State 105 to compose the State Board of Public Participation. However, the project worked on actors with veto power within the executive branch, who ultimately decided not to implement public policy through the PTP, due to interests and infighting in the government. Thus this thesis aims to analyze the factors that have prevented the action of the PTP, making the process ineffective during the years 2007 and 2010.Item Acesso aberto (Open Access) O PTP e as limitações para a efetivação de políticas públicas: participação popular no governo de Ana Júlia Carepa (2007-2010)(Universidade Federal do Pará, 2012) AGE, Yuri Pereira Carneiro; MORBACH, Marise Rocha; http://lattes.cnpq.br/6548225770072744This paper presents the participatory management model implemented by the Ana Julia government, who was in charge of Pará state executive from 2007 to 2010. Based in analysis of this mechanism for popular participation, this paper discusses the relationship between the government and the PTP advisers, focusing on capture representative members of social organizations and movements, and also the limitations that prevented the Public Administration to implement the actions and works proposed by PTP. In spite of use the Internet to overcome the territorial barriers, absorbing the concept of e-Government to advance the decentralization of public administration, more than 60% of the popular demands have not left the paper. It is concluded that a number of factors, such as the consolidation of political culture in the structures of government, the limits of information technology and planning problems to implement the PTP and to consolidate demands imposed themselves as obstacles to the full development of this participation mechanism.Item Acesso aberto (Open Access) A reeleição de vereadores evangélicos em Belém de 1992 a 2008: conexão, regra do jogo e comunicação com as bases(Universidade Federal do Pará, 2011) SILVA, Luiz Henrique da; SIQUEIRA, Edir Veiga; http://lattes.cnpq.br/9176462002883343In 2004 was elected the councilors who composed the Municipality of Bethlehem, having been occupied the vacancies left by those who were not reelected. This framework allowed the reelection of affirmation and strengthening of political parties, for several mandates, political representation and remain with seat in Parliament Hall. This is the case of the Workers Party (PT), the Brazilian Democratic Movement Party (PMDB), the Party of Brazilian Social Democracy (PSDB), Brazilian Labor Party (PTB) among others. This group has been represented in Parliament Hall for a long uninterrupted period. The champion is the renewal of mandate Councilman Paul Pastor Queiroz of IEQ (Foursquare Gospel Church) who is in his fourth term. Then comes the Cllr Baptist Pastor Raul UCKG (Universal Church of the Kingdom of God) who is in his third term and Councilman Iran Moraes of AD (Assembly of God) who is in his third term. The starting point of the research, part of the conditions suggested by Pereira and Renno (2001) and supported by Downs (1958) that the central goal of a politician is to seek reelection. Anthony Downs believes that the individual within their rationality, has the ability to interpret their choices within a logic of possible alternatives. He does not let himself be seduced by the movements of the candidates, but makes his choice within the alternative that presents itself but retains the rational choices. It is noticed that over the years, lawmakers evangelicals have shown greater strength in some denominations to remain in parliament for several terms. This is the case of parliamentarians of the Foursquare Gospel Church, Seventh Day Adventist, the Universal Kingdom of God, Assembly of God. The process of continuous renewal of mandate is based on leadership support and services provided to internal segments of Churches.Item Acesso aberto (Open Access) A relação executivo-legislativo no projeto de criação da Superintendência do Planejamento Territorial Participativo (SPTP) no Estado do Pará(Universidade Federal do Pará, 2012) ROCHA, Dalton Davis Favacho da; SILVA, Maria Dolores Lima da; http://lattes.cnpq.br/7277148176512169This study addressed the Executive-Legislative relations in Pará through Bill 01/2008 implantaria that the Superintendency of Participative Territorial Planning (SPTP), during the 16th Legislature of the Legislative Assembly of Pará in the period 2007-2010. Prepared by the State Government, the project included the establishment of an institution that would coordinate the process of popular participation and social control proposed by the government Ana Júlia Carepa early in his administration. How problematic, the study addressed the rejection by parliament to that project, whose research question was: what factors contributed to the rejection of the project of creating the SPTP by the Legislature? Moreover, what it means in Executive-Legislative relations according to the current literature. The hypotheses would be inferred that the rejection was motivated by the conflicting relationship between the Executive and Legislature in the parliamentary arena or the perception of conflict of interest of local political actors as to the boundaries of performance between political institutions and participatory representative political institutions. Members opposed to the project did not consider SPTP while effective practice democratic management, but suspected the same, for example, could be linked to strategies by the Executive for electoral purposes or bargaining before the Legislature. The development of the research has focused on the search for answers to issues presented and to verify the validity of the hypothesis inferred. As for the goal we evaluated the behavior of MPs in the course of the project to create the SPTP. As research tools were used and empirical literature searches.
