O Mestrado Acadêmico em Direito pertence ao Programa de Pós-Graduação em Direito (PPGD) do Instituto de Ciências Jurídicas (ICJ) da Universidade Federal do Pará (UFPA). Em 1984, foi reconhecido pela CAPES o Curso de Mestrado em Direito Público. Em 1987, o PPGD passou por um processo de reformas, que deram origem a duas Áreas de Concentração: Instituições Jurídico-Políticas e Instituições Jurídicas e Sociais na Amazônia. Atualmente, o Programa oferta cursos de Mestrado Acadêmico e Doutorado (único da área de Direito na Amazônia), e se estrutura em torno de uma única Área de Concentração: Direitos Humanos. Possui cinco Linhas de Pesquisa: Constitucionalismo, Políticas Públicas e Direitos Humanos; Direitos fundamentais: concretização e garantias; Direitos Fundamentais e Meio Ambiente; Estudos Críticos do Direito; Sistema penal e Direitos Humanos. Sua missão é formar profissionais que, compreendendo a realidade local, rica em recursos, mas ainda com baixos índices de desenvolvimento econômico e social, trabalhem para transformá-la. Para isso, objetiva ofertar sólida formação teórica, aliada à competência política e social.

Item Acesso aberto (Open Access) Negociação jurídica processual na execução: análise da possibilidade de constituição de títulos executivos extrajudiciais(Universidade Federal do Pará, 2022-08-29) AZEVEDO JÚNIOR, Manuel Albino Ribeiro de; COSTA, Rosalina Moitta Pinto da; http://lattes.cnpq.br/5469957203750291; https://orcid.org/0000-0002-3673-6912This work aims to analyze the viability to create enforceable instruments out of court through legal transactions and its consonance with the procedural public order. First, established by the current legislation, and the principled foundations provided for in the process, which ensure the presence of the parties’ liberty in the procedure. Then, the instrument enforceable in court are analyzed, verifying their requirements and its limits in matter of law enforcement. The institute of enforceable instruments out of court gains new contours in the current legislation, in which the civil procedure reconciles aspects of the public and private law. this section ends presenting the incidence of legal transaction within the executing procedure and its compatibility with the executive system, in view of the principles and current procedural rules that enable the selfdetermination of the parties. The following chapter aims to debate the concept of instrument enforceable and its historical development, which will allow to identify that this instrument was conceived as a technique that granted the immediate enforcement of the documents, without the cognizance procedure. Therefore, the instrument is composed by inherent and extrinsic requirements. In the material aspect, there is the obligation contained in the title, which must be precise, net, and admissible, while the formal aspects based on the legislation enables the executive procedure. At the last section, the study focus on the possibility of the creation of enforceable instrument out of court through legal transaction, to make more flexible the formal requirements that constitutes the title, allowing the players to adapt the formal aspects in view of each concrete case. Lastly, it presents the constitutional principle of freedom, as well as the procedural principle of respect to the self-regulation in the procedure, and the rule contained in article 190 of the Code of Civil Procedure to show that are enough instruments to assure the recognition of the creation of enforceable instruments from procedural legal transactions.Item Acesso aberto (Open Access) Parâmetros de aplicação da boa-fé objetiva no sistema processual civil brasileiro(Universidade Federal do Pará, 2013-02-07) LEVY, Karine de Aquino Câmara; COSTA, Rosalina Moitta Pinto da; http://lattes.cnpq.br/5469957203750291This study aims to examine the application of objective good faith under the Brazilian civil procedural law. To do so, demonstrate, primarily, that the observance of good faith in its objective feature is not restricted to civil diploma materials, especially form the objective good faith an ethical value basis in constitutional law, spreading therefore throughout the Brazilian legal system, including the legal relationships procedural. Moreover, it will verify that the objective good faith is expressed in the Brazilian Code of Civil Procedure, which provides for duties of loyalty and cooperation among all subjects of the process, which, however, is not sufficient for its realization in the process, necessitating the application of preventive and repressive measures for its observance. In this vein, it is shown the important role of the Judiciary in conducting the process in order to adapt it to the peculiarities of the case, according to social morality, seeing mainly a fair decision. Thus, the context in which it develops good faith is the Neoprocessualism, where the process is seen as an instrument for achieving good faith, morality, honesty and loyalty, representing a symbiosis between the ethical values and legal principles in the pursuit of realizing the right material.Item Acesso aberto (Open Access) Precedentes no direito brasileiro: uma análise crítica sobre a utilização do “distinguishing” no Supremo Tribunal Federal(Universidade Federal do Pará, 2013) GARCIA, André Luis Bitar de Lima; COSTA, Rosalina Moitta Pinto da; http://lattes.cnpq.br/5469957203750291The paper discusses judicial precedents in the Brazilian reality, to contribute to a better understanding of the distinguishing through the analysis of cases the Federal Supreme Court. The Brazilian system needs the force of precedent, especially given our control of constitutionality, the presence of open procedural clauses and of content of the principle of equality. However, we emphasize that the implementation of stare decisis in Brazil will not occur automatically, either via legislative imposition. From the contrast of two general theories of precedent (as previous rule Frederick Schauer principle and precedent as Ronald Dworkin), we discuss two decisions of the Federal Supreme Court, in order to establish criteria for the use of the technique of distinguishing. In the research, the precedents are considered principles, with space for a possible distinction and for the protection of fundamental rights. In the legal field, it is sustained the interpretation of devices to the use of precedents under the perspective of the proposed theory, highlighting the concepts of coherence and integrity. In the practical field, despite the existence of a different conception from the Supremo Tribunal Federal’s ministers about the use of precedents, the change of this vision is defended.Item Acesso aberto (Open Access) Precedentes vinculantes no modelo constitucional de processo(Universidade Federal do Pará, 2021-08-18) PAIXÃO, Shayane do Socorro de Almeida da; COSTA, Rosalina Moitta Pinto da; http://lattes.cnpq.br/5469957203750291; https://orcid.org/0000-0002-3673-6912This work aims analyze the binding precedents in the from the Brazilian Civil Procedure Code – CPC/2015, especially the precedents of the Supreme Court (STF). The formal linkage of the precedents is investigated, based on their provision in the Code of Civil Procedure, seeking to understand how this formal provision can reveal the defense of the linkage only by a criterion of authority of the Court that issued the decision. This criterion of authority, although important, should not be analyzed in isolation, under penalty of resuming arguments that refer to legal empiricism, a theoretical current that offers subsidies for decisions devoid of legal legal foundations. Furthermore, considering the reading of the process necessary from a constitutional model, the concern with the participation of subjects should be given special attention when analyzing the precedents of the Supreme Court. In the work, precedents are considered as principles that operate from their gravitational force, which leads to their gradual application, according to formal but also material criteria, so that the Court's authority is only one of them and not the only one. The deliberative practice of the STF is a determining point in analyzing the gradual strength of precedents.Item Acesso aberto (Open Access) O STF como Corte Interpretativa: repercussões na decisão de inconstitucionalidade (precedentes constitucionais e tipologia decisória)(Universidade Federal do Pará, 2016-11-11) MAROCCO, Jair Sá; COSTA, Rosalina Moitta Pinto da; http://lattes.cnpq.br/5469957203750291This paper analyzes how the constitutionality of decisions by the Supreme Court (STF) were precedents; More specifically, it analyzes the distinction between the effects of the decision resulting from diffuse system of constitutional and concentrated system. Based on the current jurisprudential and doctrinal reference, is critical of the current system and proposes a new legislative garb for the theme. The second part proposes a typology of unconstitutionality decision that encompasses the two major forms of cited constitutional control - Kelsen model and marsshalliano, based on the distinction between text and consecrated standard. The above two points are preceded by theoretical analysis of some of the presuppositions for understanding the Supreme Court as Court Interpretative, notably the role of creating the right judicial decision.
